General terms and conditions of business

1 Scope of Application

(1) These General Terms and Conditions (hereinafter referred to as “GTC”) apply to all contracts concerning the temporary rental of hotel rooms for accommodation purposes, as well as all additional services provided by the hotel to the guest.

(2) The contractual partner is Ushky, Isabelle und Heil, Laura (GbR), operating under the name “The Suite Garden Hotel”, Fellnerstraße 3, 60322 Frankfurt am Main (hereinafter referred to as the “Hotel”).

(3) Any differing, conflicting, or supplementary terms and conditions of the guest shall only become part of the contract if the Hotel has expressly agreed to their validity in writing.

(4) Bookings made through third-party platforms (e.g., Booking.com, Expedia, Airbnb) are additionally subject to the terms and conditions of the respective platform operator. In the event of conflict, the Hotel’s GTC shall prevail to the extent permitted by law.

 

2 Conclusion of Contract

(1) By making a booking, the guest offers to conclude an accommodation contract with the Hotel. The contract is concluded upon written or electronic booking confirmation by the Hotel.

(2) Minors under the age of 18 may only conclude an accommodation contract with the express written consent of a legal guardian. The Hotel reserves the right to request appropriate proof.

(3) There is no right of withdrawal pursuant to Section 312g (1) of the German Civil Code (BGB) for accommodation contracts, as these are excluded from the right of withdrawal pursuant to Section 312g (2) No. 9 BGB. Only the agreed cancellation conditions shall apply.

 

3 Prices and Payment

(1) All prices are stated in euros and include statutory VAT. Accommodation services are subject to the reduced VAT rate (currently 7%), while other services such as breakfast, spa use, and additional services are subject to the standard VAT rate (currently 19%).

(2) Payment conditions depend on the booked rate. The Hotel reserves the right to require advance payment, full payment, or a credit card guarantee to secure the booking. This will be indicated during the booking process and in the booking confirmation.

(3) The Hotel accepts the following payment methods: credit card (Visa, Mastercard), EC card, Apple Pay, PayPal, and bank transfer. Cash payment is possible upon prior agreement.

(4) In the event of late payment, the Hotel is entitled to charge default interest amounting to 5 percentage points above the applicable base interest rate. The right to claim further damages remains unaffected.

(5) The Frankfurt Culture and Tourism Tax (visitor’s tax) in its applicable amount shall be charged separately and shown in addition to the accommodation price.

4 Arrival and Departure / Registration Obligation

(1) Check-in is possible from 3:00 PM. Check-out must take place no later than 12:00 PM on the day of departure. Deviating times require prior agreement with the Hotel.

(2) In the event of late check-out after 12:00 PM, the Hotel is entitled to charge additional fees.

(3) There is no entitlement to early check-in or late check-out, and these are only granted subject to availability and prior agreement with the Hotel.

(4) In accordance with the German Federal Registration Act (BMG), the Hotel is required to register every guest upon arrival. The guest is obliged to present a valid photo ID and sign a registration form.

5 Cancellation and No-Show

(1) Cancellation conditions depend on the booked rate and will be communicated to the guest during the booking process and in the booking confirmation.

(2) The Hotel reserves the right to cancel the contract for good cause, particularly in cases of force majeure, false information provided by the guest, or if carrying out the stay is unreasonable for the Hotel. In such cases, payments already made will be refunded.

(4) Guests are advised to take out travel cancellation insurance.

 

6 Use of Rooms and House Rules

(1) Rooms may only be used by the number of persons specified in the contract. Transfer of the room to third parties requires the Hotel’s prior written consent.

(2) Smoking is strictly prohibited in all indoor areas of the Hotel as well as on balconies and the rooftop terrace. In the event of a violation, the Hotel is entitled to charge a cleaning fee of at least €250.

(3) Pets are only permitted upon prior notification and payment of an additional fee.

(4) Quiet hours apply from 10:00 PM to 8:00 AM. Disturbing noise at any time of day must be avoided.

(5) Guests are obliged to treat the rooms and facilities with care. The guest shall be fully liable for any damage caused by themselves or their companions. The Hotel is entitled to invoice corresponding costs immediately.

(6) In the event of serious violations of the house rules, the Hotel reserves the right to terminate the contract without notice. In such cases, payments already made will not be refunded.

 

7 Long Stay

For stays of several weeks or months, separate conditions may be agreed upon, particularly regarding price, payment terms, and cancellation conditions.

8 Private Spa

Use of the Private Spa is regulated separately during the booking process. The conditions communicated at the time of booking shall apply.

9 Events and Functions

The use of event spaces (e.g., rooftop terrace, lobby) shall be governed exclusively by the conditions agreed upon in the respective event contract. The Hotel’s GTC shall apply additionally unless the event contract contains deviating provisions.

 

10 Liability

(1) The Hotel shall only be liable for damages in cases of intent or gross negligence, as well as for breaches of essential contractual obligations (cardinal obligations). In the event of slightly negligent breaches of cardinal obligations, liability shall be limited to the foreseeable damage typical for the contract.

(2) The Hotel’s liability for items brought onto the premises shall be governed by Sections 701 et seq. BGB. Liability is limited to one hundred times the accommodation price, but no more than €3,500, unless items have been expressly handed over to the Hotel for safekeeping. The Hotel shall only be liable for cash, securities, and valuables if these have been expressly handed over for safekeeping.

(3) The limitations of liability do not apply to damages resulting from injury to life, body, or health.

 

11 Data Protection

(1) The Hotel collects and processes the guest’s personal data exclusively for the performance of the accommodation contract and to fulfill legal obligations (in particular under the Federal Registration Act).

(2) Data processing is carried out in accordance with the GDPR and the German Federal Data Protection Act (BDSG). Further information is provided in the Hotel’s privacy policy, which is available on the website and can be provided to the guest upon request.

(3) Guests have the right to access, rectify, erase, and restrict the processing of their data, as well as the right to data portability. Complaints may be submitted to the Hessian Commissioner for Data Protection and Freedom of Information (HBDI).

 

12 Final Provisions

(1) German law shall apply exclusively, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

(2) Place of performance and jurisdiction, insofar as legally permissible, shall be Frankfurt am Main.

(3) Amendments or supplements to the contract as well as these GTC must be made in writing.

(4) Should individual provisions of these GTC be or become invalid, this shall not affect the validity of the remaining provisions. The statutory provision shall replace the invalid provision.
